NOTICE IS HEREBY GIVEN THAT ORDINANCE NO. 156 WAS ADOPTED BY THE CITY COUNCIL OF THE CITY OF ELEPHANT BUTTE, NEW MEXICO DURING ITS DULY ADVERTISED PUBLIC MEETING ON SEPTEMBER 16, 2015.
Ordinance No.156 is referenced as “AN ORDINANCE AMENDING SECTIONS 31.02, 31.03 AND 31.04 OF THE CITY OF ELEPHANT BUTTE CODE OF ORDINANCES, RELATING TO A CITY ALCOHOL LICENSE TAX, IN ORDER TO CLARIFY THAT THE CITY ALCOHOL LICENSE TAX SHALL BE PAID ANNUALLY ON OR BEFORE JULY 1″.

In accordance with Section 10-15-1, NMSA 1978 (2010 Cumulative Supplement), notice is hereby given that a quorum of the Planning & Zoning Commission of the City of Elephant Butte, New Mexico may attend the following events:
August 21, 22, and 23, 2015: Various Activities pertaining to the 8th Annual Elephant Days Celebration. Activity locations include the City Event Grounds at 104 Water Street, parade route along Butte Blvd., Car Show at Elephant Butte Inn, and Balloon Regatta at Elephant Butte Lake State park. No City Business will be discussed, and no decisions will be made.

NOTICE OF PUBLIC HEARINGS FOR CONSIDERATION OF ORDINANCES Nos. 156 & 157
Notice is hereby given that the City Council will hold two public hearings on Wednesday August 5, 2015 at 2:00 p.m. at City Hall, 103 Water Street. The purpose of these hearings shall be to consider adoption of two ordinances amending the Municipal Code.
Ordinance #156: is referenced as the “Annual Alcohol License Tax Ordinance” that establishes the imposition of taxes for alcoholic beverages and providing for the collection of a municipal liquor license. Per State statute 7-24-1, NMSA 1978, the City has the authority to regulate such activity and shall adopt its policy and taxes by ordinance annually.
Ordinance #157: is referenced as the “Drainage and Erosion Impact Lots Designation Process Ordinance” that establishes a process for designating lots identified as being impacted by drainage, runoff, erosion, poor soil and/or flooding conditions or impacting adjacent lots.

NOTICE IS HEREBY GIVEN THAT ORDINANCE NO. 154 WAS ADOPTED BY THE CITY COUNCIL OF THE CITY OF ELEPHANT BUTTE, NEW MEXICO DURING ITS DULY ADVERTISED PUBLIC MEETING ON JUNE 17, 2015.
Ordinance No. 154 is referenced as “Amending City Code Sections 91 and 155 to allow the limited keeping of female chickens” and hereby amends the City Code to allow up to 5 hens on lots of at least 10,000 square feet within the R-1-A, R-1-B, R-1-C and C-2 zoning districts upon issuance of a City permit. Ordinance No. 153 is referenced as “Repealing Ordinance No. 150 ” and hereby repeals Ordinance No. 150 – previously adopted on April 1, 2015 – to provide for entering into a loan agreement with the New Mexico Finance Authority. We will be putting up the flags along Butte Blvd. and Warm Springs on Sunday, June 14.
Anyone interested in helping should report to the City Annex building on Warm Springs (green building)
at 6:30am to put up the flags, and again at 4:00pm to take them down.
Thank you to our volunteers, who tirelessly help in making Elephant Butte the most patriotic city!
Notice of Special Planning & Zoning Commission Meeting & Public Hearing
CONDITIONAL USE APPLICATION #CU-15-02
Notice is hereby given that the chairman of the City Planning & Zoning Commission has called for a special meeting of the Commission on Thursday June 25, 2015 at 9:00 a.m. at City Hall, 103 Water Street. During that meeting, the Commission will hold a public hearing to consider the application in Case #CU-15-02 from Daniel Montoya, owner of I’ll Do It Electric, to establish a construction/ contractor’s yard.
This proposed use is considered a conditional use pursuant to Section 155.033(G) of the City Code which requires a public hearing in accordance with Section 155.006(F). The subject property is located at 112 Desert View Drive and is more specifically described as Elephant Butte Estates Unit 29, Block 12, Lot 10, contained within the C-2 Commercial zoning district.
