April 20, 2015 and April 24, 2015

In Accordance with the Open Meetings Act, Public Notice is hereby given that the Governing Body of the City of Elephant Butte, New Mexico will hold the following Special Meetings:
April 20, 2015 at 10:30am at 103 Water Street, Elephant Butte, New Mexico.
April 24, 2015 at 10:30am at 103 Water Street, Elephant Butte, New Mexico.
Both meetings will meet in executive session to discuss limited personnel matters pursuant to NMSA 1978, Section 10-15-1(H)(2); City Manager.
No other matters will be discussed, no decisions will be made, and no Action is anticipated.
Agendas may be obtained through the City Clerk’s Office at 103 Water Street, Elephant Butte, New Mexico.

Dogs Relinquished

Animal Shelter has 40 really cute Corgies, Pugs, Chihuahas, and Yorkies that were relinquished on Saturday. They are in good shape, Owner just had too many. Please spread the word and adopt a dog, so we don’t have to euthanize! 575-894-6773

COMPREHENSIVE SIGNAGE PLAN APPLICATION ‪#‎CSP‬-15-01

Notice is hereby given that the City Planning & Zoning Commission will hold a public hearing on Tuesday April 7, 2015 at 9:00 a.m. at City Hall, 103 Water Street to consider a comprehensive signage plan application in case #CSP-15-01.

Signage Plan Case #CSP-15-01 – 900 Highway 195, EBE/U7/B2/1.559 ac unplatted; Butte General Store and Butte Marine; Bob Owen, Applicant / Janice M. Connor, Owner. The Applicant has submitted a signage plan pursuant to Section 152.05(B) of the City Code which requires a public hearing in accordance with Section 155.006(F).

NOTICE OF ADOPTION – ORDINANCE NO. 151

NOTICE IS HEREBY GIVEN THAT ORDINANCE NO. 151 WAS ADOPTED DURING A DULY ADVERTISED PUBLIC MEETING OF THE MAYOR & CITY COUNCIL OF THE CITY OF ELEPHANT BUTTE, NEW MEXICO ON MAY 6, 2015

 

Ordinance #151  Is referenced as “Amending the provisions of Sections 31.62, 31.64, 31.65 and 31.66 of the Lodgers Tax Ordinance generally clarifying procedures for administration of the tax, adding enforcement provisions, and increasing Civil Penalties as required by state law;  Amending the provisions of Section 31.67 relating to qualifications for members of the Lodgers Tax Advisory Board and clarifying the duties of the Board, and adding new sections 31.68, specifying eligible use of the proceeds of the Occupancy Tax, and 31.69, authorizing the Governing Body to contract for management of programs and activities funded with proceeds of the Occupancy Tax”.

and Intent to Adopt Ordinance #150

The City of Elephant Butte, New Mexico, hereby gives notice of a regular City Council meeting for Wednesday, April 1, 2015, at 2:00 p.m., at the City Administrative Offices, 103 Water Street, Elephant Butte, New Mexico. At such meeting, the City Council will consider for adoption Ordinance #150 described below. Complete copies of the proposed ordinance are available for public inspection during the normal and regular business hours of the City Clerk-Treasurer, Elephant Butte, New Mexico.
The title of the Ordinance is:
AUTHORIZING THE ISSUANCE OF THE CITY OF ELEPHANT BUTTE, NEW MEXICO GROSS RECEIPTS TAX IMPROVEMENT REVENUE BONDS, SERIES 2015 IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $550,000 FOR THE PURPOSE TO (1) FINANCE ACQUISITION AND CONSTRUCTION OF CERTAIN CAPITAL IMPROVEMENTS FOR THE BENEFIT OF THE CITY AND ITS RESIDENTS, INCLUDING CERTAIN ROAD IMPROVEMENTS AND ACQUISITION OF PUBLIC BUILDINGS, AND (2) PAY COSTS OF ISSUANCE OF THE SERIES 2015 BONDS; PROVIDING THAT THE SERIES 2015 BONDS WILL BE PAYABLE AND COLLECTIBLE FROM AND SECURED BY A PLEDGE OF THE 1/4 PERCENT (0.25%) MUNICIPAL GROSS RECEIPTS TAX DISTRIBUTED TO THE CITY PURSUANT TO SECTION 7-19D-9 NMSA 1978, AS AMENDED, AND CITY ORDINANCE NO. 26 ADOPTED MARCH 3, 1999; PROVIDING FOR THE DISPOSITION OF THE RECEIPTS DERIVED FROM SAID TAX PROCEEDS; PROVIDING THAT CERTAIN TERMS OF THE BONDS WILL BE PROVIDED IN A SUBSEQUENT RESOLUTION; PRESCRIBING OTHER DETAILS CONCERNING THE BONDS AND TAX PROCEEDS, INCLUDING BUT NOT LIMITED TO COVENANTS AND AGREEMENTS IN CONNECTION THEREWITH AND THE FORM, TERMS, CONDITIONS AND MANNER OF EXECUTION OF THE BONDS; RATIFYING ALL ACTION PREVIOUSLY TAKEN IN CONNECTION THEREWITH; AND REPEALING ORDINANCES IN CONFLICT HEREWITH.
The title sets forth a general summary of the subject matter contained in Ordinance #150. This notice constitutes compliance with Section 3-17-3 NMSA 1978.
