CITY OF ELEPHANT BUTTE
RESOLUTION NO. 24-25-121
A RESOLUTION DECLARING A LEVEL 2 FIRE CONDITION DUE TO DROUGHT
WHEREAS, the City of Elephant Butte has been experiencing higher than average tempeatures, prolonged winds, and lower humidity levels; and
WHEREAS, the City of Elephant Butte has adopted a Fire and Smoking Restrictions During Times of Drought code § 33.01 in which it allows the City Council to declare by resolution the level of hazard; and
WHEREAS, the City of Elephant Butte with recommendation from Elephant Butte Fire Department’s Fire Chief is declaring a “Level 2 Condition” It shall be unlawful during a level 2 condition to build, maintain, attend or use a fire for open burning of weeds, trash, and/or campfires except for campfires built in devices designed to contain fire. Special Burn Permits will may be issued by the Elephant Butte Fire Department designee at their discretion. It shall be unlawful to allow the accumulation of dry vegetation; and
WHEREAS, in addition to this Level 2 Condition declaration it is advised by the City of Elephant Butte and Elephant Butte Fire Department for all constituents to call the non-emergent dispatch number to report all burns, even contained fire pits. Central Dispatch (575)894-7111. It is the primary goal and service action of the Elephant Butte Fire Department to “Serve the Community” before all else; and
WHEREAS, the City of Elephant Butte shall in accordance with adopted code § 33.04 post the adopted resolution at all posting locations as adopted by the open meetings act.
BE IT THEREFORE RESOLVED by the City Council of the City of Elephant Butte that the above named resolution Declaring a Level 2 Fire Condition Due to Drought be posted at all posting locations and shall take effect immediately and shall remain in effect until the resolution is rescinded or superseded.
PASSED, APPROVED AND ADOPTED by the City Council of Elephant Butte on this 14th day of May 2025 in regular session, at Elephant Butte, Sierra County, New Mexico.
